This guide is about how to obtain and keep the título de familia numerosa in the Comunitat Valenciana. What the título gives you (discounts, deductions, transport) is a separate article we are preparing. Here we cover only the conditions, documents, filing channels and deadlines.
Information, not legal advice
We rely on Ley 40/2003, its regulation RD 1621/2005, the Valencian Decreto 14/2021 as amended by art. 71 Ley 3/2026, and the procedimiento 377 page on sede.gva.es. Every rule is cited in the text and in the sources block. Your case (separated parents, guardianship, disability, your status in Spain) may require documents that are not listed here. Before filing, check the procedure page or ask at the Dirección Territorial.
Who counts as familia numerosa
The definition comes from Ley 40/2003 (art. 2) and is the same across Spain. As of 2026-10-26:
- General rule: one or two parents (ascendientes) with three or more children, shared or not (art. 2.1).
- Two children count as a large family only in special cases (art. 2.2):
- at least one of the children has a disability or is unable to work;
- both parents have a disability, or one of them has a degree of at least 65%, or they are unable to work;
- one of the parents has died (a widow or widower with two children — last paragraph of art. 2.2);
- A divorced or separated parent with three or more children also qualifies, even if the children live in different households, provided there is economic dependence and a court order on maintenance (art. 2.2.c).
- Disability for the purposes of the law means a recognised degree of 33% or more; inability to work means incapacidad permanente absoluta or gran invalidez (art. 2.5).
An unmarried parent with two children is not a familia numerosa
Art. 2 Ley 40/2003 has no case for "a single parent, neither widowed nor divorced, with two healthy children". For such families the Comunitat Valenciana has a separate título de familia monoparental. According to the Conselleria FAQ, both recognitions are compatible, but benefits of the same class under the two títulos do not add up. Do not confuse the two documents.
Conditions for the children
For a child to be included in the título (Ley 40/2003 art. 3.1; RD 1621/2005 art. 1.1), they must:
- be unmarried and under 21 — or have a disability or be unable to work, at any age;
- if studying, the age limit extends up to and including 25 — the regulation lists the types of education that count;
- live with the parent or parents; temporary separation for study, work or medical treatment does not break the link. For non-EU nationals, Ukrainians included, this applies only to a temporary move within Spain (RD 1621/2005 art. 1.1.b): a child studying in Ukraine or another country is not included in the título;
- depend economically on the parents. If the child works, their annual income must not exceed a threshold that the law ties to one indicator and the regulation to another (see "Not confirmed" below).
Nobody can belong to two family units at the same time, and one person cannot hold two títulos (art. 3.3).
Categories: general and especial
Ley 40/2003 (art. 4) divides families into two categories:
- Especial — five or more children, or four if at least three were born in a multiple birth or were adopted or taken into foster care at the same time.
- General — everyone else.
- A family with four children can obtain especial on income grounds: if income per family member does not exceed 75% of the reference indicator. The law names the SMI; the GVA page and the FAQ name the IPREM; we do not give the threshold in euros (see "Not confirmed").
- A child with a disability or unable to work counts as two when the category is determined (art. 4.3).
Residence: who must be a resident
Ley 40/2003 gives non-EU foreigners the right to the título on the same terms as Spaniards, provided that all family members who give the right to the benefits are residents of Spain under Ley Orgánica 4/2000 (art. 3.2). The GVA repeats this requirement in its PDF "Requisitos de residencia" and adds its own: the family must have its domicilio in the Comunitat Valenciana, and the application is filed in the province of residence (sede.gva.es, procedimiento 377; Decreto 14/2021 art. 15 as amended by Ley 3/2026).
The practical consequence: a child who stayed in Ukraine will not be included in the título.
Not confirmed: temporary protection and the título
As of 2026-10-26, no official source we checked (the Ucrania Urgente portal, the procedimiento 377 page, the Conselleria FAQ, Decreto 14/2021, Ley 3/2026) says directly whether holders of temporary protection are granted the título. What is known: the law requires residence under LO 4/2000 (Ley 40/2003 art. 3.2); temporary protection grants a residence permit (RD 1325/2003 art. 16) and, according to the Ucrania Urgente portal, a residence and work permit for the whole duration of the protection; and the Valencian rule accepts from foreigners a document proving the residence permit when it is not evident from the identity document (Decreto 14/2021 art. 8.2.k as amended by Ley 3/2026). We draw no conclusion from this. File the application with the TIE of every family member and ask in writing at the Dirección Territorial of your province, or via 012, whether they apply art. 3.2 to temporary protection. If you get an answer, keep it: it will be useful at renewal.
We do not give the dates of temporary protection itself in this guide: they change, and the dates differ for the Spanish card and for the EU decision. The current status is in the guide "From temporary protection to residence in Spain".
Who applies and where
- Competence lies with the autonomous community where the applicant lives (Ley 40/2003 art. 5.2). A título issued in Valencia is valid throughout Spain without further recognition.
- Applicant — either parent, a guardian, an acogedor, a guardador or another family-unit member with legal capacity (art. 5.1).
- Procedure in the Comunitat Valenciana — procedimiento 377 "Solicitud de alta o renovación del Título de Familia Numerosa. Carné de Familia Numerosa", Conselleria de Servicios Sociales, Familia e Infancia, SIA code 210630. As of 2026-10-26 the page shows "Plazo de solicitud: Abierto".
- Where the file goes — to the Dirección Territorial of the province where the family lives (Decreto 14/2021 art. 15 as amended by Ley 3/2026). The address for the province of Valencia on the procedure page: Av. del Oeste 36, 46001 València. See the same page for the Alicante and Castellón addresses.
Documents
The list comes from Decreto 14/2021 (art. 8 as amended by art. 71 Ley 3/2026) and the procedimiento 377 page. As of 2026-10-26.
Always:
- the completed and signed application (the form from the procedure page — fill in all personal-data fields);
- a valid DNI or TIE/NIE for every family member included in the título;
- proof of kinship: libro de familia, extracts from the Registro Civil or other valid documents. If the data is in the Spanish Registro Civil, the administration checks it itself and the libro de familia is needed only when the check fails;
- a certificado de empadronamiento for every member of the family unit;
- declaraciones responsables: that nobody holds another título, that the children depend on the parents, that the family situation matches what is declared, and the undertaking to report changes within three months.
In specific cases:
- for foreigners under LO 4/2000 — a document proving the residence permit, if it is not evident from the identity document submitted (art. 8.2.k);
- for the especial category on income grounds — the family members' IRPF returns or consent to have them checked (art. 8.2.a);
- in case of divorce or separation — the court order on maintenance (Ley 40/2003 art. 2.2.c);
- in case of disability — proof of the degree; the administration requests it itself unless you object.
Foreign documents must come with a translation into one of the official languages of the Comunitat and, where required, be legalised (art. 8). How a sworn translation and apostille of Ukrainian documents is done is in the guide "Sworn translation and apostille of documents from Ukraine".
The administration checks a lot itself
Under art. 10 bis Decreto 14/2021 (introduced by Ley 3/2026) the administration itself retrieves data on identity documents, empadronamiento, disability, dependencia (recognised need for care), inability to work, retirement pension, legal residence and university studies — unless you expressly object. Tax data it checks only with your explicit consent. Tick this on the form if you are applying for especial on income grounds: otherwise you will have to attach the returns.
Not confirmed: the wording on the sede.gva.es page
As of 2026-10-26 the procedimiento 377 page still asks for proof of the residence permit only from those who submitted a NIE provisional. The current text of the law (art. 8.2.k) is wider: the document is required whenever the permit is not evident from the identity document. The page also refers to the repealed Decreto-ley 14/2025 rather than Ley 3/2026. Go by the law: attach proof of your residence permit if it is not obvious from your card.
How to apply: step by step
Check the family composition and residence
Check your family against the rules above: number of children, their age, marital status, studies, living together. Make sure every member who gives the right to the título has a valid residence permit in Spain and that the family is empadronada in the Comunitat Valenciana. For EU/EEA nationals this requirement does not always apply: art. 3.2 Ley 40/2003 admits a family living in another EU/EEA country if one of the parents works in Spain.
Gather the documents
Identity documents of all members, libro de familia or civil-registry extracts, empadronamiento of all members, proof of residence where needed, translations of foreign documents. If the family is getting its empadronamiento for the first time, start there: how it works in Valencia is in the guide "Empadronamiento in Spain".
Choose the filing channel
The law allows any place listed in art. 16 Ley 39/2015 and prefers the sede electrónica of the Generalitat (Decreto 14/2021 art. 7 as amended by Ley 3/2026). Online — on sede.gva.es with the certificado digital or Cl@ve of any interested party or representative. How to get the certificate is in the guide "Certificado digital with a NIE". In person — download the form from the procedure page, fill in all fields and file it at the Dirección Territorial of your province or at any place listed in art. 16.4 Ley 39/2015.
If you go in person, book an appointment
The Conselleria page (marked as updated in March 2024) mentions a cita previa by phone on 012 (or 963 866 000) or online, including at PROP offices. The procedimiento 377 page says nothing about appointments. Call ahead — it is cheaper than a wasted trip. If you have no means of electronic signature, the registration offices (9:00–15:00) have a funcionario habilitado who helps with identification and signing.
File the application
Processing and issuance are free: the procedure page says "no devenga tasas" (citing DA 3.ª Ley 40/2003); the Conselleria FAQ confirms the exemption from any fees. Keep the dated proof of filing: benefits are counted from that date.
Wait for the decision
The deadline is three months. If there is no decision, the application is deemed approved by silencio administrativo (procedimiento 377 page, Resolución section). The appeals procedure is described there too.
Receive the título and carnés
According to the Conselleria FAQ, the family receives the título de familia numerosa and individual carnés for each member. Benefits apply from the date the application was filed — both at first recognition and at renewal (Ley 40/2003 art. 7.1), provided the decision is positive (RD 1621/2005 art. 4.1).
Validity and renewal
As of 2026-10-26:
- Validity. Since 30 December 2025 the título is valid until the eldest child included in it turns 26 — provided that age is the only requirement determining its effects (Decreto 14/2021 art. 3.2). The rule was introduced by Decreto-ley 14/2025 (in force from 30.12.2025, later repealed); since 03.07.2026 the same text is carried verbatim by art. 71 Ley 3/2026. If another condition affects the term — for example, the residence permit of one of the members — validity is limited by it.
- Not confirmed. The Conselleria FAQ (no update date) still describes the old rule: validity until the eldest child's 21st birthday, up to 26 for students. The page was not updated after the reform. Assume that validity depends on the children's ages and on the residence permits, and check the date on the título itself.
- Expiry of a residence permit. For a renewal where the título stopped being valid because a family member's residence permit expired, the file includes that person's TIE/NIE with the new expiry date (Decreto 14/2021 art. 9.2.c as amended by Ley 3/2026). For families under temporary protection this means: after your cards are renewed, check the título and file a renewal if needed.
- When to renew. At any time, preferably before the expiry date of the old título; if circumstances change — within three months of the change (procedimiento 377 page, Plazo section).
- Filing late. If you file the renewal after the título has expired, the family is not recognised as familia numerosa from the expiry date until the filing date (Conselleria FAQ, question 16).
- Prórroga. If the old título has expired and the renewal is still pending, you can get a prórroga — it is valid for three months from the expiry date of the old título. For a renewal due to a change in family composition, use the current título until there is a decision. There is no prórroga for a first application (procedimiento 377 page, PRÓRROGA section; FAQ, question 29).
- If fewer than three children remain. The título stays valid as long as at least one child meets the conditions — but only for the members who still qualify (Ley 40/2003 art. 6).
- Revocation. The competent body may at any time before expiry revoke the título or change the date of its effects if circumstances have changed (Decreto 14/2021 art. 3.3 as amended by Ley 3/2026).
Obligations after you receive it
- Report changes — address, birth, death, emancipation, divorce, marriage — within three months (Ley 40/2003 art. 17.1). If the category depended on income, income is confirmed every year in the first quarter.
- Report when a child over 21 stops studying — within three months (Decreto 14/2021 art. 10.1 as amended by Ley 3/2026). With validity running to age 26, this is the main trap for families with students.
- Do not conceal or misrepresent. Concealing or giving false information about the legal requirements is a serious offence (infracción grave, Ley 40/2003 art. 18.3.b): suspension of benefits for up to two years. Loss of beneficiary status is provided only for very serious offences (infracciones muy graves), that is, repeated serious ones (art. 18).
- One título per person. Nobody can belong to two family units at the same time (art. 3.3).
Not confirmed: what we deliberately do not state
As of 2026-10-26 the sources disagree or are silent on these points. We do not assert them.
- The child's income threshold and the threshold for especial on income grounds. Ley 40/2003 (art. 3.1.c and 4.2) ties them to the SMI; RD 1621/2005 (art. 1.1.c) and the GVA to the IPREM. We do not give amounts in euros; ask the Dirección Territorial which indicator they apply.
- Temporary protection and the right to the título. See the block above: there is no direct official answer.
- Appointments for filing in person. The Conselleria mentions a cita previa via 012; the procedimiento 377 page does not mention appointments. Call.
- The text on sede.gva.es. The page refers to the repealed Decreto-ley 14/2025 and asks for proof of residence only with a NIE provisional; the law (Ley 3/2026 art. 71) is wider.
- Validity in the FAQ. The Conselleria FAQ describes the pre-reform rule (age 21); the current one is 26, provided age is the only requirement.
Common mistakes
- Assuming a single parent with two children is a familia numerosa. Under Ley 40/2003 it is not; that is familia monoparental, a separate título.
- Including a child who stayed in Ukraine. Everyone who gives the right to the título must be a resident of Spain.
- Turning up without the empadronamiento of all family members after objecting to the de oficio check. The empadronamiento is required by art. 8.1.d; the administration can retrieve it itself under art. 10 bis, but only if you do not object.
- Filing the renewal after the título has expired. A gap arises from the expiry date to the filing date.
- Not reporting a move or the birth of a child. The deadline is three months, and the breach is sanctioned.
- Filing in the wrong province. The file goes to the Dirección Territorial of the province where the family lives.
- Not keeping the proof of filing. Benefits count from the filing date, and that is the date you will have to prove.
This article is for information only and is not legal advice. All rules and deadlines were checked against primary sources on 26 October 2026: Ley 40/2003 and RD 1621/2005 (BOE), Decreto 14/2021 as amended by art. 71 Ley 3/2026 (BOE-A-2026-15683, DOGV 10396), the procedimiento 377 page on sede.gva.es and the Conselleria FAQ. Check them: the Valencian pages are updated more slowly than the law. What benefits the título gives is the subject of the next article.
